Obligations of a Permanent Residence Permit Holder

Are you living in the Czech Republic and have been granted permanent residence after 5 years of residency? While a permanent residence permit undoubtedly offers numerous benefits, it is crucial to remember that it also comes with specific legal obligations you should keep in mind. Below is an overview of the most important requirements that may apply to you.

One of the primary obligations tied to your permanent residence is a broad reporting obligation. What does this entail? You must remember to report various changes – whether it involves a change of surname, residential address, or marital status.

Change of Residence Address

First, let us look at reporting a change of address. Compared to a long-term residence permit, an exception applies to permanent residence: you only need to report the change if you plan to stay at the new address for more than 180 days. The time limit for reporting this change is 30 days from the date of your relocation. Therefore, the change is reported only after it has occurred.

You can report the change in person at the office of the Ministry of the Interior (OAMP) with jurisdiction over your new place of residence. For example, if your new address is in Prague 4, you will need to visit the office of the Department for Asylum and Migration Policy of the Ministry of the Interior (OAMP MV ČR), Foreigners' Residence Unit Prague II – Chodov. You can verify which office you fall under on the official information portal for foreigners of the Ministry of the Interior (ipc.gov.cz). Furthermore, the change can also be reported by mail, via a data box (in Czech: datová schránka), by email with a recognized electronic signature, or through an authorized representative. In addition to the change notification form, you will need to attach your valid travel document, residence permit card, proof of accommodation, and pay the administrative fee.

Other Changes of Personal Data

A change of name, surname, marital status, data in your travel document, as well as data in your residence permit, must be reported to the Ministry of the Interior office within 3 working days from the day the change occurred. A longer time limit applies if you are a family member of an EU citizen.

Once the decision on granting permanent residence becomes legally binding, you also become a participant in the public health insurance system by law. Please do not forget that you must explicitly report the granting of permanent residence to your health insurance provider within 8 days of the date the permanent residence was granted.

Obligation to Hold Valid Documents

Another obligation is to reside in the territory of the Czech Republic with a valid travel document and residence permit. In the event of loss, destruction, damage, or theft of your residence document, you must report this fact to the Ministry of the Interior within 3 working days.
