Change of the Purpose of Stay

The purpose of stay is an integral part of virtually all residence permits, and its existence and proof are also a necessary requirement for their issuance. What purposes can you reside under in the Czech Republic, and what should you do if you wish to change your originally fulfilled purpose? How does the Ministry proceed in situations where you fail to fulfill it? In this article, we summarize everything you need to know and what to watch out for.

Residence permits in the Czech Republic are tied to a so-called purpose of stay. All residence permits, except for permanent residence, must be based on a specific reason for the foreign national's stay in the country. There are many types of purposes, such as study, employment, business, or family reunification. The most common purposes are study and employment. A typical scenario that leads to a change in the purpose of stay is when a foreign national (a student) applies at a diplomatic mission for a long-term residence permit for the purpose of study and subsequently graduates from a university here. What happens next? Their residence is based on the purpose of study, which is now concluding. Does this mean they must return home? No. Naturally, they can apply for a change of purpose of stay.

Changing the purpose of stay provides foreign nationals with the option to alter their residence status during their stay. The most frequent situation is the aforementioned case of a student entering the labor market after graduation. They apply at the Ministry of the Interior to change their purpose of stay from study to seeking employment, which grants them the time needed to explore further opportunities. Subsequently, they may also apply for an Employee Card or a Blue Card. How should you proceed? An application for a change can only be submitted in person at an office of the Ministry before the current residence permit expires.

Exceptions and Restrictions on Change of Purpose

However, there are exceptions that you should bear in mind. It is not always possible to simply request a change of the purpose of stay without meeting additional criteria. Therefore, we highly recommend consulting your specific situation before taking any major steps. Let us look at some of these exceptions:

  • Long-term residence for the purpose of business: You can generally only apply for this permit after 5 years of continuous residence in the territory. The only exception applies to holders of a long-term visa for the purpose of business and holders of a long-term residence permit for the purpose of seeking employment or starting a business.
  • Long-term residence for the purpose of seeking employment or starting a business: To obtain this permit, the applicant must currently hold a long-term residence permit for the purpose of study or scientific research. Furthermore, it is essential that this study or research is coming to an end.
  • Long-term residence for the purpose of family reunification and for the purpose of tolerated stay: If you hold these types of residence permits, you can generally only apply to change your purpose to another long-term residence permit after 3 years have elapsed.

What happens if you do not fulfil the purpose of your stay?

A foreign national is legally obliged to fulfill the permitted purpose of stay throughout its entire validity period, not merely formally, but factually. If you do not properly fulfill the purpose of your stay and submit an application for its extension, the Ministry will generally not approve it and will reject the application. It may also happen that the Ministry of the Interior will refuse to issue a different long-term residence permit, even if it is requested for a different purpose. In extreme cases, your current permit may even be revoked.
